Terms and Conditions of Purchase and Use
These Terms and Conditions shall be valid as of 23.02.2020.
1.1. The Terms and Conditions of Purchase and Use govern the rights and obligations arising between a customer (hereinafter: Customer) of magrada.eu online store (hereinafter: Online Store) and Magrada OÜ with the purchase of goods. The seller of goods is Magrada OÜ (hereinafter: Seller), address: Järva 9b, Pärnu 80023, Estonia, registry code: 1280763, phone: +372 5264206, e-mail: email@example.com. The terms apply to any legal relationship between the Customer and the Seller in the purchase of goods through the Online Store.
1.2. Seller reserves the right to change and complement the Terms and Conditions of Purchase and Use. These changes will be made available on the Seller’s web pagehttps://www.magrada.eu/en/contact/terms-and-conditions-of-purchase-and-use/. If the Customer ordered before the change of terms, the terms valid at that time shall apply.
1.3. The Customer has the right to save these The Terms and Conditions of Purchase and Use before making the purchase.
Validity of terms of sale, product and price information
2.1. The terms of sale apply to purchases of goods from the Magrada Online Store.
2.2. The prices and quantities of the products sold in the Online Store are indicated with the products.
2.3. The Online Store prices are in Euros.
2.4. The delivery costs are valid in accordance with clause 5 of the Terms and Conditions of Purchase and Use.
2.5. The information and description of the goods are provided in the Online Store directly next to the goods and include VAT (20%).
Placing an order
3.1. Orders can be placed as a guest on the Magrada Online Store.
3.2. To order goods, the Customer must add the desired products to the shopping cart.
3.3. The Customer chooses the most suitable delivery method.
3.3.1. To place an order, fill in the required fields and select the SmartPOST or Omniva parcel machine where the goods will be delivered.
3.4. The Customer pays in the payment methods offered by the Seller.
3.5. When placing an order, the Customer checks that all the data entered is correct before paying.
3.6. The Seller sends the Customer an email confirmation of the order and receipt of payment.
3.7. The contract between the Seller and the Customer enters into force when the amount payable is transferred to the bank account of the Online Store.
3.8. If the ordered goods cannot be delivered due to stock availability or for any other reason, the Customer will be informed as soon as possible and the money will be refunded promptly, but no later than within 14 days of receiving the notification.
4.1. The Customer can pay for the order with a bank link or a bank card (Visa or MasterCard) through Maksekeskus.
4.2. In Magrada Online Store, Customers can use the bank link in the following banks: Estonia: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay and Liisi ID. Latvia: Swedbank, SEB, Citadele and Luminor. Lithuania: Swedbank, SEB and Luminor. Finland: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki and Säästopankki.
4.3. Transactions made through Maksekeskus are settled in euros and the purchase amount is also deducted from Customer accounts in euros.
4.4. The Customer pays the full price of the product by confirming the order.
4.5. To the cost of the order may be added a service charge according to the contract between the Customer and the bank or credit card issuer.
Delivery of goods
5.1. Goods can be ordered to SmartPOST and Omniva parcel machines.
5.2. Domestic shipments generally arrive at the destination within 2-5 business days from the date of the entry into force of the contract of sale.
5.3. The Customer is informed of the arrival of the goods at the parcel terminal by SMS, which contains a door code to open the parcel machine door.
5.4. The Seller shall not be liable for any damage caused to the Customer if, for reasons beyond the Seller’s control, the third party has acquired the parcel machine door code and the goods have been received on the basis thereof.
5.5. In case the Customer has not gone to receive the goods to the parcel machine after the deposit deadline, the Seller will consider that the Customer has given up the goods.
5.6. Seller shall not be held responsible for a delay in delivery, if the goods were handed over to logistics partners on time, but the delivery was delayed due to circumstances that Seller could not control.
Right of Withdrawal and Complaints Submission Process
6.1. After receiving the order, the Customer has the right to withdraw from the contract entered into with the Online Store within 14 days. The right of withdrawal does not apply if the Client is a Legal person.
6.2. Control of goods
6.2.1. Upon receipt of the goods, the Customer undertakes to open the order without damaging the package and products.
6.2.2. In case the Customer discovers, upon receipt of the goods, that the wrong or defective goods have been sent to or the goods have not reached the Customer in good condition and in sealed packaging, the Seller must be immediately informed by e-mail firstname.lastname@example.org.
6.2.3. The Seller is responsible for the goods purchased by the Customer during transportation. The Seller shall not be liable for any damage or loss of the goods upon receipt of the goods.
6.3. Depending on the products, the Customer may not have the right of withdrawal. In such case the corresponding products must comply with the conditions listed in § 53 (4) of the Law of Obligations Act. These include used products, products with ruined or damaged packaging by the Customer. To use the 14-day right of withdrawal, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store. If the goods have been used for any purposes other than is necessary to ascertain the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the Online Store shall have the right to reduce the refund according to the value of the goods.
6.4. To return the goods, you must submit a withdrawal request and send it to email@example.com 14 days of receiving the goods.
6.5. The Customer shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).
6.6. The Customer must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that the goods are handed over to the carrier within the aforementioned period.
6.7. Upon receiving the returned goods, the Online Store shall return all of the payments received from the Customer based on the contract immediately, but no later than after 14 days.
6.8. The Online Store has the right to refuse to make the refund until the goods being returned are received or until the Customer has provided proof of returning the products, whichever occurs first.
6.9. The Online Store has the right to withdraw from the sale and reclaim the goods from the Customer if the price of the goods in the Online Store was mistakenly marked significantly lower the market price of the goods.
7.1. The promotional code is a combination of numbers and/ or letters that allows you to shop at Magrada Online Store at a discount. Promotional codes are unique, which means that promotional codes can offer different value of discounts that apply to all or a part of our product range.
7.2. The promotional code is valid for a limited period and you will be notified about the date when the promotional code is received.
7.3. Promotional code terms
7.3.1. The promotional code applies only to products on the Magrada Online Store.
7.3.2. The promotional code gives you an additional discount on products, including to those that are already on sale. When you enter the correct promotional code, the discount will be added automatically when you make a purchase in the shopping cart, after confirmation.
7.3.3. Expired promotional codes are invalid and will not be exchanged for a new code.
7.4. Campaign promotional codes
7.4.1. Additional information on the value and duration of promotional codes can be found through advertising channels or the Magrada website.
7.4.2. The campaign promotional codes can apply to all or individual products.
7.5. Use of promotional codes
7.5.1. The promotional code of the Magrada Web Store can be used by anyone who has received information about the campaign via email, SMS, social media, or any other advertising channels.
7.5.2. The Customer selects desired product(s) and adds them to the shopping cart.
7.5.3. Under the selected products in the shopping cart, you will find a field labelled “The promotional code” where you can apply the code. The discount applies automatically.
7.5.4. The Customer selects the shipping method and fills the required information about the order formatter. After confirming the cart, the payment method needs to be selected.
7.6. Magrada OÜ has the right to change the principles and value of the promotional code.
Settlement of Disputes
8.1. All the complaints about the Online Store should be sent by email to firstname.lastname@example.org. The claim must include the Customer’s name, contact information, date of claim, defect in the goods and the content of the claim, and must include proof of purchase.
8.2. Claims are settled by negotiation between the Seller and the Customer.
8.3. If the Customer and Seller are not able to settle the dispute by agreement, the Client may contact the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between the Customer and the Online Store.
8.4. The Purchaser may also address to the dispute resolution bodies of the European Union (https://ec.europa.eu/consumers/odr/main/?event=main.home2.show).
Information relating to the processing of Customer’s personal data
9.1. The Seller has the right to process personal data and purchases data provided by the Customer in accordance with applicable legislation.
9.2. Personal data will be processed primarily to complete an order placed by the Customer at the Magrada Online Store.
9.3. The data processor is the Seller, which processes Customer data in order to serve the Customers of the Online Store.
9.5. The Online Store uses the personal information (including name, phone number, e-mail address, bank details) entered by the Customer to process the order (order completion, communication with the Customer, answering Customer’s inquiries), sending the goods to the Customer and compiling sales statistics.
9.6. The Online Store forwards personal information to the transport service companies in order to deliver the goods.
9.7. The Online Store will only send newsletters and offers to the Customer’s e-mail address if the Customer has requested this by entering an e-mail address on the website and announcing their wish to receive mail notifications.
9.8. The Customers may opt out of email offers and newsletters at any time by notifying the Seller via email or following the instructions in the email containing the offers.
